General Terms and Conditions

The following General Terms and Conditions (Allgemeine Geschäftsbedingungen - AGB)

1. Applicability

These General Terms and Conditions (AGB) are valid for all shipments from the company TL-Modellbau, Danziger Str. 19, 26160 Bad Zwischenahn, Germany

2. Contract partner

The purchase contract is concluded with TL-Modellbau, Petra Budde, Danziger Str. 19, 26160 Bad Zwischenahn, Germany, Phone: +49-4403-6929560, e-mail: budde@tl-modellbau.de.

3. Offer and conclusion of contract

3.1 The portrayal of a product in our on-line shop is an invitation to place an order; it does not constitute a legally binding offer. All offers are valid "while stocks last", unless stated otherwise in connection with specific products. Errors and omissions excepted.

3.2 By clicking the [Place order] button you submit a binding declaration of your wish to order the goods listed on the Order page. The purchase contract is concluded when we accept your order. Acceptance takes the form of our confirmation of the contract by e-mail immediately after receipt of your order, or by dispatching the shipment immediately after receipt of the order.

4. Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us (TL-Modellbau, Petra Budde, Danziger Str. 19, 26160 Bad Zwischenahn, Germany, Phone: +49-04403-6929560, e-mail: budde@tl-modellbau.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

5. Prices and carriage costs

5.1 The prices stated on the product pages include VAT.

5.2 In addition to the stated prices we charge the cost of carriage. You are clearly informed of the carriage cost on the product pages, and it is repeated in the goods basket system and on the Order page.

6. Delivery

6.1 The delivery time is generally 1 to 3 working days for goods which are in stock.

7. Payment

7.1 We only accept the displayed as part of the ordering process. The customer can choose freely between the displayed payment methods. The payment methods, please consult the Payment.

7.2 We reserve the right to accept certain payment types or exclude.

7.3 If you select advance payment as your method of payment, we will inform you of our bank details in our confirmation of contract, and supply the goods after receipt of payment.

7.4 In case of advance payment, the customer agrees to pay the purchase price immediately after contract conclusion.

8. Reservation of title

8.1 In the case of consumers we reserve title to the purchased goods until we receive full payment of the invoice amount. If you are a businessman exercising your commercial or independent occupational activity, a member of the public legal profession or a public / legal institutional fund, we reserve title to the purchased goods until settlement of all open claims from the business relationship with the customer. The corresponding security rights are transferrable to third parties.

8.2 You only have a right to compensation if your counter-claims are deemed to be legally valid, or are undisputed or acknowledged by us. Moreover you only have a right of retention if your counter-claim is based on the same contractual relationship.

8.3 If the customer is in arrears with us in respect of any payment obligations, then all existing claims are immediately due.
